Pool Release of Liability and Assumption of Risk

New Community's pool related activities, the undersigned adult, parent or legal guardian acknowledges and agrees to the following:

1. I fully understand that swimming pool activities involve a certain level of risk of injury, and that these risks and dangers exist while in the pool as well as in the surrounding pool areas. These risks include physical injuries, psychological injuries and even the possibility of loss of life;

2. I hereby accept the risks of me and/or my child's participation in the swimming pool activities and will hold the New Community and its employees, counsellors, agents, elders, members and affiliates harmless from any and all liability, actions, demands, damages, expenses, costs, claims, and causes of action of any possible nature in respect of injury, death loss or damage caused as a result of or in any way relating to activities in the swimming pool and around the pool area;

3. I further agree to indemnify and hold harmless the operators of New Community and its employees, counsellors, agents, elders, member and affiliates from and against any and all liability incurred as a result of or in any manner related to me or my child's participation in swimming pool activities;

4. If, despite the signing of this waiver, a lawsuit is brought against New Community and its employees, counsellors, agents, elders, members and affiliates in relation to my child's participation in the swimming pool activities, I agree to pay for any and all court costs and attorney fees incurred as a result of such litigation;

5. I also declare that neither I nor my child, if applicable, are under the influence of any chemical substance including alcohol that may impair my mental faculties and sound judgement, at the time of the signing of this release or at the time of my child's participation in pool activities;

6. I agree that if any provision of this release is found to be unenforceable or invalid in any way, the remaining provisions will remain in force and in effect;

Minor Child: Release of all Claims, Waiver of Liability 1. In consideration of New Community of Maple Valley, WA, a non-profit religious corporation, its officers, directors, employees, volunteers and members (collectively “NCC”) organizing, arranging and permitting my minor child to attend and participate in the event described above and any activity related to said event, as the parent or legal guardian of said minor child and on behalf of said minor child, I hereby release and discharge NCC from all liability, and agree to indemnify and hold NCC harmless against any liability whatsoever for all actions, damages causes of actions, suits, costs, losses, expenses, claims and damages which I, my spouse, or family members now have or hereafter may have resulting from or arising in connection with said minor child’s travel to, attendance at or participation in this NCC event or related activity. 2. To the best of my knowledge, my child(ren) can fully participate in this activity. I am full aware of risks and hazards connected with the activity, including but not limited to the risks as noted herein, and I hereby elect to voluntarily participate in said activity, and to enter the above-named premises and engage in such activity knowing that the activity may be hazardous to me and my property. I VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR ANY RISKS OF LOSS, PROPERTY DAMAGE, OR PERSONAL INJURY, INCLUDING DEATH, that may be sustained by me or my child(ren), or any loss or damage to property owned by me, as a result of being engaged in such activity, WHETHER CAUSED BY THE BY THE NEGLIGENCE OF THE RELEASEES or otherwise. 3. It is my express intent that this Release and Hold Harmless Agreement shall bind the members of my family and spouse (if any), if I am alive, and my heirs, assigns and personal representative, if I am no alive, shall be deemed as a RELEASE, WAIVER, DISCHARGE AND COVENANT NOT TO SUE the above name RELEASEES. I herby further agree that this Waiver of Liability and Hold Harmless Agreement shall be construed in accordance with the laws of the state of Washington. 4. I UNDERSTAND THAT THE CHURCH WILL NOT BE RESPONSIBLE FOR ANY MEDICAL COSTS ASSOCIATED WITH AN INJURY I OR MY CHILD(REN) MAY SUSTAIN. 5. I further agree to become familiar with the rules and regulations of the Church concerning conduct and not to violate said rules of any directive or instruction made by the person or persons in charge said activity and that I will further assume the complete risk of any activity done in violation of any rule or directive or instruction. 6. I also understand that I should and am urged to obtain adequate health and accident insurance to cover any personal injury to myself and child(ren) which may be sustained during the activity or the transportation to and from said activity. IN SIGNING THIS RELEASE, I ACKNOWLEDGE AND REPRESENT THAT I have read the foregoing Waiver of Liability and Hold Harmless Agreement, understand it and sign it voluntarily as my own free act and deed; no oral representations, statements or inducements, apart from the foregoing written agreement, have been made; I am at least eighteen (18) years of age and fully competent; and I execute this Release for full, adequate and complete consideration fully intending to be bound by same. 7. I grant permission to NCC Mega Sports Camp, its agents, and its employees the irrevocable and unrestricted right to produce photographs and video taken of my child(ren), myself, and members of my family while at NCC Mega Sports Camp for any lawful purpose including, publication, promotion. illustration, advertising, trade, or historical archive in any manner or in any medium by NCC Mega Sports Camp. I hereby release NCC Mega Sports Camp and its legal representatives from liability for any violation or claims relating to said images or video. 8.Furthermore, I grant permission to use the statements of my child, myself, or my family members given during an interview or evaluation with or without my name for the purpose of advertising and publicity without restrictions to time limit or geographic area. I waive my right, my child's rights, my family's rights to any and all compensation stemming from the use of these materials. IN WITNESS WHEREOF, I have hereunto set my hand on this.
